A BILL FOR AN ORDINANCE AMENDING THE ZONING OF THE PROPERTY LOCATED SOUTH OF 72ND AVE. TO THE SOUTHERN BOUNDARY OF WESTMINSTER STATION PARK BETWEEN LOWELL BOULEVARD ON THE WEST AND FEDERAL BOULEVARD ON THE EAST, ALL LOCATED IN ADAMS COUNTY, COLORADO FROM B-1, C-1, M-1, O-1, R-3, R-4, AND PUD TO THE SPECIFIC PLAN DISTRICT (SPD)
THE CITY OF WESTMINSTER ORDAINS:
Section 1. The City Council finds:
a. That a rezoning of the properties generally located south of 72nd Ave., north of the southern boundary of Westminster Station Park, east of Lowell Boulevard, and west of federal Boulevard, all as described in Exhibit A, attached hereto, from the B-1, C-1, M-1, O-1, R-3, R-4, and PUD zones to a SPD zone is desirable because:
1. The current zoning is inconsistent with one or more of the goals or objectives of the City's Comprehensive Plan and with the land use designation for the area. The area has been previously designated as a Focus Area in the Comprehensive Plan. As a designated Focus Area, the Comprehensive Plan and §11-4-7.5, W.M.C., require the adoption of SPD zoning and a Specific Plan for the Property. Therefore, the current zoning designations are inconsistent with the designation of the property as a Focus Area pursuant to the Comprehensive Plan.
2. The surrounding development is or may be adversely impacted by the current zoning.
b. That the notice requirements of W.M.C. §11-5-13 have been met.
c. That such rezoning has been referred to the Planning Commission, which body held a public hearing thereon on February 14, 2017 and has recommended approval of the requested amendments.
d. That Council has completed a public hearing on the requested zoning pursuant to the provisions of Chapter 5 of Title XI of the Westminster Municipal Code and has considered the criteria in §11-5-3(A), W.M.C.
e. That based on the evidence produced at the public hearing, a rezoning to the proposed SPD zone complies with all requirements of the Westminster Municipal Code, including, but not limited to, the provisions of W.M.C. §11-4-3, requiring compliance with the Comprehensive Plan, and §11-5-3, W.M.C..
Section 2. The Zoning District Map of the City is hereby amended by reclassification of the properties, described in Exhibit A, attached hereto and incorporated herein by reference, from the B-1, C-1, M-1, O-1, R-3, R-4, and PUD zoning districts to the SPD zoning district, as depicted on Exhibit B, attached hereto and incorporated herein by reference.
Section 3. This ordinance shall take effect upon its passage after second reading.
Section 4. The title and purpose of this ordinance shall be published prior to its consideration on second reading. The full text of this ordinance shall be published within ten (10) days after its enactment after second reading.
